“This paper examines Africa’s fight against impunity in light of the decision of the Prosecutor of the International Criminal Court to investigate President Omar Al Bashir of Sudan for his alleged involvement in the crimes that have occurred in Darfur and the subsequent recent decision by the Court to issue a warrant for his arrest. The aim is to understand the salience or lack of it in upholding the principles of democracy, human rights, the rule of law, and good governance, as well as condemning and rejecting impunity as encapsulated in the African Union Constitutive Act Union. In order to achieve this objective, the history of Africa’s response to the establishment of the Court and the African Union’s (AU) commitment at a continental and international level to fight impunity will be charted and considered.”
